The Rajasthan High Court expressed concern over the systemic deficiencies in the implementation of the Juvenile Justice Act, particularly in relation to preliminary assessments of children accused of heinous offences and the rehabilitation of Care Leavers, and issued wide-ranging directions to State authorities for institutional reforms.
The Sessions Court having noted that the convict was 16 years old at the time of trial, held that he was entitled to the benefit of the Children Act, 1960 and thus he was directed to be kept in a children’s home in accordance with the provisions of the 1960 Act to give him a chance to reform himself.
The statutory mandate under Section 23 of the JJ Act must be strictly adhered to, ensuring that children in conflict with law are not subjected to joint proceedings with adults, regardless of whether they are being tried under the procedure applicable to adults.
