What happens to children when they turn 18 and leave care? Rajasthan HC’s directions on Care leavers and JJ Act reforms

The Rajasthan High Court expressed concern over the systemic deficiencies in the implementation of the Juvenile Justice Act, particularly in relation to preliminary assessments of children accused of heinous offences and the rehabilitation of Care Leavers, and issued wide-ranging directions to State authorities for institutional reforms.

The primary objective of the JJ Act is the rehabilitation of juveniles rather than punishment. The grant or denial of bail/suspension should be based on the individual’s conduct and circumstances, not solely on the severity of the offense.

If consensual relationship cases are segregated from the pending cases, it will be easy to deal with them and in appropriate cases, the Court can also exercise its jurisdiction and quash the proceedings, if the proceedings are ultimately going to be against the interest and future of the children involved in those cases and it is found to be an abuse of process of Court.
