Does an Australian driving licence establish the right to drive in India? Punjab & Haryana HC answers
Punjab and Haryana High Court examined the legal status of a foreign driving licence in India in the context of a motor accident compensation claim. The Court considered whether an Australian domestic driving licence could satisfy the requirement of a “valid and effective” driving licence under the Motor Vehicles Act, 1988, and also examined the impact of the appellant’s acquittal in the related criminal proceedings on the findings of the Motor Accidents Claims Tribunal.
