Proposal for appointment of Justice Virendra Kumar-II, Additional Judge of the Allahabad High Court, as Permanent Judge.

With a view to assess merit and suitability of Justice Virendra Kumar-II for appointment as Permanent Judge, we have carefully scrutinized the material placed on record including certain complaints received against him. On overall assessment based inter alia on additional information received from the Chief Justice of the Allahabad High Court, observations made by the Department of Justice in the file and having regard to all relevant factors, the Collegium is of the view that Justice Virendra Kumar-II, Additional Judge, is suitable for being appointed as Permanent Judge.

In view of the above, the Collegium resolves to recommend that Justice Virendra Kumar-II, Additional Judge be appointed as Permanent Judge of the Allahabad High Court against one of the existing vacancies.

Supreme Court Collegium comprising of Ranjan Gogoi, CJ and S.A. Bobde and N.V. Ramana, JJ. recommends the appointment of Justice Arup Kumar Goswami as the Chief Justice of the Sikkim High Court.

Office of the Chief Justice of the Sikkim High Court would be falling vacant shortly, consequent upon retirement of Justice V.K. Bist, Chief Justice of that High Court. Therefore, appointment to that office is required to be made.

Justice Arup Kumar Goswami is the senior-most Judge from Gauhati High Court and has been functioning there since his elevation. Having regard to all relevant factors, the Collegium is of the considered view that Justice Arup Kumar Goswami is suitable in all respects for being appointed as Chief Justice of the Sikkim High Court. The Collegium resolves to recommend accordingly.

1. Justice Rajasekhar Mantha,
2. Justice Protik Prakash Banerjee,
3. Justice Sabyasachi Bhattacharyya,
4. Justice Moushumi Bhattacharya,
5. Justice Shekhar Bobby Saraf, and
6. Justice Rajarshi Bharadwaj

Collegium comprising of Ranjan Gogoi, CJ and S.A. Bobde and N.V. Ramana, JJ. stated that,

For the purpose of assessing merit and suitability of the abovenamed recommendees for appointment as Permanent Judges, we have carefully scrutinized the material placed on record, including certain complaints against some of the above-named recommendees. 

On overall assessment and having regard to all relevant factors including the views of our consultee-colleagues, concurrence of the State Government, the Judgment Committee Report and the observations made by the Department of Justice in the file, the Collegium is of the view that

Justices (1) Rajasekhar Mantha, (2) Sabyasachi Bhattacharyya, (3) Moushumi Bhattacharya, (4) Shekhar Bobby Saraf, and (5) Rajarshi Bharadwaj, Additional Judges, are suitable for being appointed as Permanent Judges.

Whereas, in regards to Justice Protik Prakash Banerjee Collegium is of the considered view that, for the present, he be appointed as Additional Judge for a fresh term of six months w.e.f. 21-09-2019.

Proposal for appointment of Dinesh Pathak, Advocate, as Judge of the Allahabad High Court.

Having regard to all the relevant factors, and the material placed on record, the Collegium is of the considered view that Shri Dinesh Pathak is suitable for elevation to the High Court.

Therefore, collegium comprising of Ranjan Gogoi, CJ and S.A. Bobde and N.V. Ramana, JJ. recommended that Dinesh Pathak, Advocate be appointed as a Judge of the Allahabad High Court.
