Can’t Let Public Confidence Erode: Inside the BCI Order Suspending Advocate Samarth Singh Over Dowry Death Allegations

BCI suspension of Advocate Samarth Singh

On 22 May 2025, the Bar Council of India issued an Interim Order suspending Advocate Samarth Singh in the matter relating to death of Ms. Twisha Sharma, wife of Advocate Samarth Singh.

Reasons for urgent suspension:

  1. An FIR was registered against Advocate Samarth Singh in relation to allegations of dowry death, cruelty and allied offences.

  2. Advocate Samarth Singh has been absconding1 since then and has not cooperated with the investigation.

  3. The allegations are grave and have a direct bearing upon the dignity, discipline, and public image of the legal profession.

  4. An advocate is not merely a private individual, but an officer of the Court and a member of a regulated profession.

  5. The Bar Council of India is under a statutory duty to preserve the purity of the profession and to ensure that the conduct of advocates does not erode public confidence in the administration of justice.

In view of the above stated reasons, the Bar Council found it necessary to pass an urgent interim order in the interest of the legal profession and public confidence.

Hence, Advocate Samarth Singh is suspended from practice as an advocate from immediate effect, i.e. 22 May 2026.

Effect of suspension:

He cannot appear, act, plead, practice, file vakalatnama, or hold himself out as entitled to practice before any Court, Tribunal, Authority or forum in India.

This matter will also be placed before the appropriate Disciplinary Committee for confirmation, modification, vacation or further orders.

1. Subsequent to the issuance of this interim suspension order by the Bar Council of India, Advocate Samarth Singh has surrendered to the authorities. This report reflects the position as on 22 May 2026, the date of the BCI order.
