On 18 May 2026, the Ministry of Power appointed the date 1 June 2026 on which the various amendments made in the Damodar Valley Corporation Act, 1948 vide the Jan Vishwas (Amendment of Provisions) Act, 2026 will come into force.
Revised provision relating to “Penalty” under Section 53 of the Damodar Valley Corporation Act, 1948 that will be enforced starting from 1 June 2026 says:
-
If someone breaks Section 17 or its rules:
-
They will be fined up to Rs. 10 lakh for each offence.
-
If the violation continues even after conviction, they will have to pay an extra daily fine between Rs. 1,000 and Rs. 50,000 for each day the failure continues.
-
-
A court can allow the person to pay Rs. 10 lakh to settle the offence instead of continuing the case.
-
Once this amount is paid, no criminal case will be started or continued against that person.
-
Paying this amount will be treated the same as an acquittal.
-
A person can use this option of compounding only once.
Note: “Section 17. Construction of dam, etc., prohibited except with the approval of the Corporation.—Save as otherwise prescribed, no person shall construct, operate or maintain in the Damodar Valley any dam or other work or any installation for the extraction of water without the consent of the Corporation.”
