Rouse Avenue Court: In a bail application for regular bail filed by applicant, an accused in NEET-UG paper leak case, under Section 483, Nagarik Suraksha Sanhita, 2023 (BNSS) (corresponding to Section 439 CrPC), Ajay Gupta, Special Judge (PC Act), dismissed the bail application and refused to grant her bail.
The instant matter arose from the alleged leakage of the NEET-UG examination paper, a highly competitive national medical entrance examination. Following allegations of a large-scale paper leak and examination malpractice, the investigation was entrusted to the Central Bureau of Investigation (CBI). Several individuals were arrested for their alleged participation in the conspiracy surrounding the leak. The applicant was one of the accused persons arrested during the course of the investigation under Ss 61(2), 238, 316(5), 318(4) and 303(2), Nyaya Sanhita, 2023 (BNS), S. 13(2) read with S. 13(1)(a), Prevention of Corruption Act, 1988 and S. 10 read with Ss. 3, 4, 5 and 11, Public Examinations (Prevention of Unfair Means) Act, 2024.
