Delhi Victims Compensation Scheme 2018

On 5-1-2024, the Government of the National Capital Territory of Delhi published an amendment of Delhi Victims Compensation Scheme, 2018 vide which the definition of “Victim” and the provisions relating to “Interim Relief to Victims” has been revised. The provisions came into effect on 5-1-2024.

Key Points:

  1. Earlier, the “Victim” meant any person who suffered loss or injury as a result of offence and in case of death of a person, the guardians or legal heir of that person was covered under the ambit of victim.

    Now, in addition to the above provision, some specific parameters have been determined that will make any person “Victim”, namely-

    • Injury due to mob violence and

    • Injury due to mob lynching.

  2. For the purpose of Compensation, the said victim should be treated as a victim by the Court or Investigating Agency.

  3. Interim relief and the interim compensation, in relation to injury due to mob violence/ mob lynching, will be provided within 30 days from the date of offence.

  4. The minimum limit of interim compensation of Rs. 50000 will not apply to the cases of mob violence/ mob lynching victims.

  5. The upper limits of compensation will be applicable as per the Schedule containing detailed specifications of various kinds of “Particulars of loss or injury”.
