Holding that Athar Khan’s role was prima facie distinguishable from co-accused granted bail by the Supreme Court, the Delhi High Court dismissed his second bail appeal in the 2020 Delhi riots conspiracy case under the UAPA.
Upon comparing the allegations against the appellant with those against other co-accused who were granted bail by Supreme Court, the Delhi High Court concluded that there was “no major distinction” between their respective roles.
