Bombay High Court: In a petition seeking grant of leave under Clause XII of the Letters Patent, in the context of a proposed suit alleging infringement of Preity Zinta’s personality rights and related claims arising from AI-generated and digitally disseminated content, a Single Judge Bench of Abhay Ahuja, J., allowed the petition and granted leave to institute the suit for injunction to protect her personality rights, holding that the pleadings sufficiently demonstrated that Preity Zinta’s goodwill, reputation and persona were situated within the Court’s jurisdiction.

Preity Zinta (petitioner) is a renowned, award-winning actress, film producer, entrepreneur and a widely celebrated personality. She proposed to institute a suit against defendants seeking an injunction for breach of personality rights, infringement of copyright, loss of immense goodwill and reputation, as well as violation of her moral rights under Section 62, Copyright Act, 1957 (Copyright Act).
It was alleged that the defendants had created, uploaded, disseminated and made available to the public AI-generated deep fake videos, memes, manipulated images, AI-generated chatbot personas and other digital contents across various platforms, thereby infringing the petitioner’s rights. It was submitted that the petitioner is an Indian national who primarily resides and works for gain in Mumbai and that her goodwill, reputation, persona and features thereof are situate within the jurisdiction of this Court. The petitioner further contended that dissemination of the offending material was taking place not only within Mumbai but globally through online platforms.
The petitioner’s counsel submitted that although respondents had offices outside the Court’s jurisdiction and part of the cause of action arose outside, a substantial part had arisen within the jurisdiction. Therefore, leave under Clause XII of the Letters Patent was sought to enable the Court to entertain, try and dispose of the proposed suit.

The Court noted the submissions made by the counsel and highlighted the averments contained in Para 7 of the leave petition and Para 39 of the plaint and granted leave under Clause XII of the Letters Patent to enable the petitioner to file the proposed suit.
