Kheda Public flogging case

Supreme Court: In an appeal against the Gujarat High Court order, wherein the Court found 4 Gujarat police officers guilty of committing contempt of court and sentenced them to undergo 14 days of simple imprisonment and a fine of Rs. 2000 for their involvement in the public flogging of Muslim men in Kheda, Gujarat, the division bench of BR Gavai and Sandeep Mehta, JJ. Has stayed the contempt proceedings against four police officers.

The High Court had charged the police officers with contempt of court, after the five Muslim men approached the court alleging a violation of the DK Basu guidelines on custodial torture.

The incident occurred on 03-10-2022, during a garba event in Kheda district of Gujarat. In the video clips, police officers were seen flogging individuals accused of disrupting the event. The victims, belonging to the minority community, filed a contempt petition in the Gujarat High Court against 13 police personnel, alleging flogging and illegal detention, while invoking the Supreme Court’s guidelines outlined in the D.K. Basu v. State of W.B., (2015) 8 SCC 744.
