About Centre for Arbitration and Research

MNLU Mumbai’s Centre for Arbitration and Research (CAR) seeks to carry out research in arbitration law and practice, contribute to policy discussion, and provide a platform for the training of arbitration professionals. CAR wishes to emphasize research and training in contemporary and emerging issues of arbitration law, specifically in niche practice areas, often unexplored by academia, but highly relevant for practitioners, such as construction arbitration, maritime arbitration, investment arbitration, sports arbitration, etc. CAR was founded under the patronage of Vice-Chancellor Prof. (Dr.) Dilip Ukey. CAR’s Faculty Coordinator is Chirag Balyan, Assistant Professor of Law at MNLU Mumbai.

About the Distinguished Guest Lecture Series on International Arbitration

The distinguished guest lecture series on International Arbitration was commenced in the year 2021 under the aegis of IRIArb. The aim is to invite distinguished arbitration practitioners to speak on contemporary issues in arbitration. The first three lectures were delivered by Prof. Julien Chaisse (Professor at the City University of Hong Kong), Mr. Kevin Kim (Senior Partner, Peter & Kim, Korea), and Ms. Chiann Bao (Independent Arbitrator, Singapore). The December 2022 distinguished lecture will be delivered by none other than Prof. Jeffrey Waincymer.

Theme for this lecture

Theme of this lecture is: “Identifying Intent to Arbitrate and Arbitral Validity: why have so many common law courts tied themselves into unnecessary and unresolved knots when aiming to discern the law applicable to the arbitration agreement?”

About the Speaker:

Prof. Jeff Waincymer is an independent arbitrator and mediator and also consults generally in the fields of international trade and investment, customs law and trade remedies. He is also currently an adjunct Professor at the Faculty of Law, National University of Singapore. He is on the HKIAC, SIAC, AIAC and ICDR arbitration panels and is an honorary Fellow of CIArb. Jeff was previously an Australian Government Nominee as a panelist for the WTO and ICSID. He has conducted pro bono legal capacity building in a range of developing countries and for a range of aid agencies. He is the author of Procedure and Evidence in International Arbitration (Kluwer); WTO Litigation: Procedural Aspects of Formal Dispute Settlement (Cameron May), and Australian Income Tax: Principles and Policy (2nd ed Butterworths) and a joint author of A Guide to the New UNCITRAL Arbitration Rules (Cambridge University Press), A Practical Guide to International Commercial Arbitration (Oceana) and International Trade Law: Commentary and Materials (2nd ed Law Book Company) as well as numerous scholarly articles.
