The Delhi High Court on 15 October 2026 granted interim relief to Emami Agrotech Limited and directed FSSAI to not take any steps in furtherance to the Show Cause Notice dated 5 June 2026 and FSSAI’s Letter dated 17 July 2026 issued to Food Safety Authorities across the country, until the next date of hearing.
The order was passed by Hon’ble Justice Amit Mahajan in W.P.(C) 15491 of 2026.
The Show Cause Notice alleged that Emami’s registered brand name “Emami Healthy & Tasty” used for its edible oil range, including sunflower oil and kachchi ghani mustard oil is found to be misleading and in contravention of various provisions of the Food Safety and Standards Act, 2006 and Regulations framed thereunder. On that basis, the letter of 17 July directed the Commissioners of Food Safety across the country to initiate enforcement action and take necessary measures to ensure Emami’s products, amongst various other FBOs, are not manufactured, distributed, marketed or sold.
Emami challenged these actions taken by FSSAI for not being in accordance with law.
Emami Agrotech was represented by Senior Advocate, Mr. Sandeep Sethi and briefed by Partners Smarika Singh and Saifur Rahman Faridi, along with Senior Associate Jasneet Jolly and Associate Ridhima Bhardwaj from Shardul Amarchand Mangaldas & Co(SAM).
SAM recently secured a relief for Emami before the Calcutta High Court against FSSAI Kolkata’s actions.
