The Moot Proposition revolves around the State’s failure to preserve an inventoried wetland that was leased for industrial development and explores the tension between ecological conservation and developmental interests. It investigates the extent of the judiciary’s power to compel the State Government to protect an area when discretionary power has been vested in the State Government under the Wildlife (Protection) Act, 1972 and whether third-party rights can coexist with such protection. It also examines the interface between the Wetland (Conservation and Management) Rules, 2017 and the CRZ Notification, 2019.
