transfer justice Arvind Singh Chandel

On 20-03-2024, the Supreme Court Collegium comprising of Dr Justice D.Y. Chandrachud, the Chief Justice of India, Justice Sanjiv Khanna, Justice B.R. Gavai, Justice Surya Kant and Justice Aniruddha Bose, issued a Resolution recommending the transfer of Justice Arvind Singh from Chhattisgarh High Court to Patna High Court.

On 15-03-2024 the Collegium had proposed to transfer Justice Arvind Singh Chandel to Madras High Court for administration of justice. However, Justice Chandel via communication dated 17-03-2024, had requested reconsideration of the proposal of his transfer or to consider transferring him to any of five High Courts viz. Rajasthan, Madhya Pradesh, Allahabad, Punjab and Haryana or Delhi.

The Supreme Court Collegium consulted one of the Judges of the Supreme Court conversant with the affairs of the High Court of Chhattisgarh and Chief Justice of the High Court of Judicature at Patna, who conveyed his consent to the proposed transfer.

Upon consideration of Justice Chandel’s request and the afore-stated consultations, the Collegium refused to reconsider their proposal to transfer Justice Chandel or to transfer him to any of the afore-stated five High Courts.

However, appreciating Justice Chandel’s difficulty, the Collegium partially acceded to his request and resolved to recommend that Justice Arvind Singh Chandel be transferred to the High Court of Judicature at Patna, instead of the Madras High Court.
