Punjab and Haryana High Court: In a petition under Section 439 of Criminal Procedure Code, 1973 (‘CrPC’) seeking regular bail for Ex- CIA In-charge Pritpal Singh accused of assisting the accused in Sidhu Moose Wala murder case in absconding from custody, involving offences under Sections 222, 224, 225-A, 212, 216 and 120-B of Penal Code, 1860 (‘IPC’) and Sections 25, 54 and 59 of Arms Act, 1959, Mahabir Singh Sindhu, J. granted bail while noting that he had been in custody for more than a year, and charges were yet to be considered.

The petitioner in the instant matter was accused of helping the accused in Sidhu Moose Wala murder case, a member of Lawrence Bishnoi gang who was involved in criminal cases like murder, attempt to murder, dacoity, etc., in absconding from custody in a very mischievous manner, who was taken by the In-Charge CIA Staff Mansa, SI Pritpal Singh regarding recovery of weapons from him. It was alleged that the said accused absconded from custody under a conspiracy, since the petitioner took him away alone in his private vehicle in the absence of any other security along with him.

It was contended that the petitioner was in custody since 2-10-2022 and the charges were yet to be considered. In addition, the said run-away accused was re-arrested on 31-10-2022.

The Court posted the instant matter to be next heard on 25-01-2024 and in the meantime, allowed the petitioner to be released on interim bail after furnishing bail bonds and surety bonds to the satisfaction of the Trial Court.
