On 22-08-2022 , the  Ministry of Consumer Affairs, Food and Public Distribution notified the Legal Metrology (Packaged Commodities) (Third Amendment) Rules, 2022  in order to amend Legal Metrology (Packaged Commodities) Rules, 2011. These Amendments will come into force with effect from January 01, 2023 .

Key Points :

  • A new clause has been added in the Rule 26 of the Legal Metrology (Packaged Commodities) Rules, 2011 which provides exemption in respect of certain packages;
  • Clause (f) under Rule 26  has been inserted providing commodities such as a garment or hosiery selling in loose or open at the point of sale in such manner that the consumer can inspect the products before buying. However, such product shall bear the following details, namely:-

A. Name and address of the manufacturer or marketer or brand owner or importer with country of origin or manufacture in case of imported products;

B. Consumer care email id and phone number;

C. Sizes with internationally recognizable size indicators such as S, M, L, XL, XXL and XXXL along with details in metric notation in terms of cm or m, as the case may be;

D. Maximum retail price of the package inclusive of all taxes in Indian currency.

  • Further, the exemption under this clause shall apply to sale of finished products alone; and the above information shall be displayed on e-commerce website if such product is sold through e-commerce.
