Dr. Ram Manohar Lohiya National Law University, Lucknow (RMLNLU) in association with the Confederation of Alumni for National Law Universities Foundation (CAN Foundation), is all set to host an insightful Online Lecture with Mr. Justice Siddharth Mridul, Judge, High Court of Delhi, Mr. Justice Atul Sreedharan, Judge, High Court of Madhya Pradesh as Keynote Speakers along with Mr. Siddharth Luthra, Eminent Senior Advocate, Supreme Court of India on 17th January, 2021, i.e., Sunday at 4:30 P.M. The Panelists shall be deliberating upon the topic of “Bail & Jail: The Rule and the Exception”. The discussion assumes colossal significance in view of the recent cases of Supreme Court and High Courts on granting of bail in High Profile cases and reasoning of personal liberty as a Constitutional Guarantee. The event will also witness the Unveiling Ceremony of ‘Chandragupt E-Magazine (2020 Edition)’.

Siddharth Luthra

Mr. Justice Siddharth Mridul, enrolled as an Advocate in 1986 and used to practice before the High Court of Delhi, High Court of Judicature at Bombay, Karnataka High Court at Bangalore, Rajasthan High Court at Jaipur, and at various Tribunals and Commissions at Delhi. He was elevated as a Judge in 2008 at the young age of 45. Prior to that, he was appointed as the Standing Counsel, Union of India in 2004 and Senior Panel Counsel for Union of India in February 2006. He was designated as Senior Advocate in May 2006 and elected as a Member of the Bar Council of Delhi for two terms 1992-1998 and 1998-2003 serving as Honorary Secretary and Vice-Chairman respectively. Mr. Justice Atul Sreedharan used to practice independently before the Indore bench of the Madhya Pradesh High Court till his elevation in 2016. Represented the State of Madhya Pradesh as Panel Advocate before the High Court of Madhya Pradesh, Bench at Indore from 2001 to 2003, and as a Government Advocate from 2003 to 2004. He was on the panel of the Kendriya Vidyalaya Sangathan from the year 2004 till July 2012. He was appointed as Central Government Counsel on 19/09/05 till 19/09/08 and again as Central Government Counsel (Senior Panel) on 19/02 /10 till 19/02/13. Mr. Siddharth Luthra is a Senior Advocate at the Supreme Court of India & specialises in Criminal Law, White-Collar crimes and Cyber Frauds.

The Panel will undertake a thorough discussion on the following themes: – 

  • Discussing the emergence of Constitutional guarantee as a device to protect individual liberty against the State as an evolving concept and its relation to Bail.
  • Analysis of various jurisdictions of Bail and legal position in India.
  • Examination of the Law Commission of India Report(s) on Provisions related to Bail in Cr.P.C.
  • Critical Analysis of Indian and Foreign Jurisdictions.
  • Ensuring Accessible justice at the Sessions Court Level in Bail Matters & reducing Pendency of Bails at the High Court level by making Lower Courts more independent & decisive.
  • Discussing the status of Bail in High Profile Cases, accessibility of Subordinate Courts and impact of Social and Caste factors in granting Bail.
  • Discussing the provisions of Bail in Special Legislations in India.

The Welcome address shall be delivered by Prof. (Dr.) S.K. Bhatnagar, Vice-Chancellor, RMLNLU, Lucknow. Prior to this, he served as Dean (Law) and Acting Vice Chancellor of BBAU, Lucknow and has served almost for four decades as law teacher in University departments. He was also the Member of the First Academic Council of the National Law School, Bangalore in 1987. He has been nominated by the Chief Justice of India as the member of the Executive Council of the Indian Law Institute in 2006. Prof. Bhatnagar has published a dozen of reputed journals and is a member of various academic bodies of repute.
