On 1 June 2026, the Government of Bihar notified the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) (Repeal) Ordinance, 2026.
It repeals the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025.
The ordinance was promulgated by the Governor under Article 213(1) of the Constitution of India.
The Bihar Shops and Establishment Act 2025 was enacted to regulate employment and service conditions in shops and establishments, but with the enforcement of the Occupational Safety, Health and Working Conditions Code, 2020 it creates overlapping provisions.
Aimed at reducing regulatory duplication and promoting investment, the ordinance ensures legal continuity. It states that any proceedings initiated under the repealed Act will continue as if the Act had not been repealed, thus, preventing disruption in ongoing cases and maintaining administrative stability.
This move reflects the government’s aim to simplify labour laws, eliminate regulatory overlaps, and create a more business-friendly environment.
