Arvind Kejriwal's plea against ED arrest

Supreme Court: The Special Bench comprising of Sanjiv Khanna, MM Sundresh and Bela Trivedi, JJ. was convened to hear the matter today and allowed Delhi Chief Minister Arvind Kejriwal to withdraw the petition filed under Article 32 of the Constitution against his arrest by the Directorate of Enforcement in Delhi Excise Policy case today.

Delhi Chief Minister Arvind Kejriwal was arrested by the Directorate of Enforcement (‘ED’) at his residence in connection with the Delhi Excise Policy case on 21-03-2024. A writ petition was filed under Article 32 of the Constitution challenging the arrest by the ED. On 20-03-2024, the Delhi High Court sought response from the ED on maintainability of the plea filed by Kejriwal challenging the summons issued to him by the ED. Two weeks’ time was granted to the ED for submitting the reply and the matter was listed for 22-04-2024. Earlier, the Rouse Avenue Court granted bail to Kejriwal subject to furnishing bail bond of Rs 15,000 and a surety of Rs 1 lakh.

ED’s investigation had revealed that K Kavitha MLC, Telangana Legislative Council along with others conspired with the top leaders of Aam Aadmi Party (AAP) including Kejriwal and Manish Sisodia for getting favours in the Delhi Excise policy-formulation and implementation. It was alleged that in exchange for these favours, K Kavitha paid an amount of Rs. 100 Crore to the leaders of AAP.
