Five Judges of the Supreme Court of India have been affected by Swine Flu which is caused by H1N1 virus. In order to curb the situation in the apex court, the following preventive measures were immediately undertaken by the Ministry of Health & Family Welfare, Government of India:

  • The First Aid Post (FAP) of CGHS was strengthened at the Supreme Court premises.
  • All the judges were provided treatment as per the protocol. Prophylactic treatment was also given to all who have come in contact with them including their family members.
  • All five judges were kept in home isolation.  Of these, three Judges have already resumed their duty and two continue to be under home isolation/observation and are recovering.
  • The court rooms and residences are being sanitised.
  • Awareness regarding preventive measures was disseminated to all concerned.

An H1N1 sensitization workshop for lawyers and other staff members will also be conducted by Ministry of Health & Family Welfare, Government of India at Bar Council of India office tomorrow i.e. 26th February, 2020.

Although H1N1 is a seasonal infection which usually occurs every year with two peaks (One in January to March and other between July to September), everyone is requested to take the preventive measures such as cover your nose and mouth with a tissue/handkerchief while coughing or sneezing; wash your hands often with soap and water; avoid crowded places; avoid touching your eyes, nose or mouth; stay away from crowded places if you have cough/cold; drink plenty of water; sleep well. In case of any symptoms, the nearest public health facility may be contacted immediately.

The Collegium considers that the following two persons are deserving and suitable in all respects for being appointed as Judges of the Supreme Court of India:

1. Mr. Justice Bhushan Ramkrishna Gavai,
Judge, Bombay High Court, and

2. Mr. Justice Surya Kant,
Chief Justice, Himachal Pradesh High Court
(PHC: Punjab & Haryana)

“While recommending the names of Mr Justice Bhushan Ramkrishna Gavai and Mr Justice Surya Kant, the Collegium has taken into consideration combined seniority on all-India basis of Chief Justices and senior puisne Judges of High Courts, apart from their competence, conduct and integrity. The Collegium has also kept in mind the desirability of giving due representation on the Bench of the Supreme Court, as far as possible, to all the High Courts as well as to all sections of the society including those belonging to SC/ST/OBC categories, women and minorities. We are also conscious of the fact that some High Courts have remained unrepresented in the Supreme Court.”

In view of the foregoing, the Collegium comprising of Ranjan Gogoi, CJ and S.A. Bobde, N.V. Ramana, Arun Mishra and R.F. Nariman, JJ. resolves to recommend that appointments be made in the following order:
1. Justice Bhushan Ramkrishna Gavai, and
2. Justice Surya Kant

Reconsideration of the recommendation for the elevation of Justices (1) Aniruddha Bose, and (2) A.S. Bopanna, as Judges of the Supreme Court.

“The Collegium is of the view that, as laid down by the Supreme Court in its Opinion in Re: Special Reference No. 1 of 1998 reported in (1998) 7 SCC 739, though inter-se seniority amongst Judges in their High Courts and their combined seniority on all India basis should be given due weightage, merit should be the predominant consideration. The Collegium accordingly kept in mind these parameters while recommending the above two names.”

Collegium comprising of Ranjan Gogoi, CJ and S.A. Bobde, N.V. Ramana, Arun Mishra and R.F. Nariman, JJ. resolves to reiterate the afore-mentioned recommendation dated 12-04-2019, especially since nothing adverse regarding competence, conduct or integrity of Mr. Justices (1) Aniruddha Bose, and (2) A.S. Bopanna, has been pointed out.
