Transport Commissioner, Government of Haryana passed an order restricting the use of BS-3 petrol and BS-4 diesel vehicles and the violation of the said order would attract prosecution under Section 194(1) of the MV Act.
The Court rebuked the ACP’s ignorance of the rules governing his service and was of the view that he needed to be trained properly by making him aware of the rules and protocols.
“It takes extraordinary courage for an accused to speak out for the atrocities committed by any police official. Simply because the allegations are coming from the mouth of the accused should not be the reason to outrightly disbelieve him.”
Vikrant J. recorded that when the benefit of two ACPs was granted to the plaintiff after the completion of 10 and 20 years of service respectively, there is no justification for not granting him the benefit of 3rd ACP after the completion of 30 years of satisfactory service before retirement.
