On 13-8-2025, the Government of the National Capital Territory of Delhi notified the Delhi BNSS (Service of Summons and Warrants) Rules, 2025 to repeal the Delhi BNSS (Service of Summons) Rules, 2025. The provisions came into effect on 14-8-2025.

These Rules come under the ambit of the Nagarik Suraksha Sanhita, 2023.

These Rules have introduced various concepts such as Crime and Criminal Tracking Network and Systems, Case Information System, Disclosed Electronic Mail Address, eSign.

Generation of process:

The Courts will generate and issue process in electronic mode through Case Information System.

Every process issued in electronic communication will be written in the language of the Court and will be encrypted.

The electronically generated process and warrant of arrest will bear the image of the seal of the Court and will also have eSign of the Presiding Officer of the Court.

eSign will be in such manner that the name of the Court and the capacity in which the signatory/ subscriber acts should be clearly mentioned.

Summons will also be served electronically, if required it can be accompanied with soft copies/ scanned copies of complaint, charge-sheet, documents.

Register of details:

It will be maintained by the Officer In-charge of every Police Station in electronic form for entering the requisite particulars of every person against whom summons, and warrants have been issued.

Where during inquiry/ investigation/ trial it appears to the police office/ Court that a situation can arise where any person may have to be served with summons or warrants, such police officer or Court may ask such person to furnish a declaration addressed to the Officer In-charge of the concerned Police Station stating the requisite particulars specified in Schedule I.

Officer In-charge will have to send the Register to the Judicial Magistrate/ Special Court concerned on a monthly basis through official email and this information will be maintained in Case Information System.

Verification of details to be done by the officer In-Charge before entering the details in Crime and Criminal Tracking Network and Systems.

In case where a complaint is filed on the basis of a private complaint, the complainant will provide the details relating to address, disclosed electronic mail address, phone number and messaging application of the accused and witnesses along with the complaint.
In case such information is not available, the complaint will make an endorsement to that effect. -
Non-disclosure of details (electronic mail address, phone number and messaging application) of victim and witnesses.
The officer has to ensure that the identity of the victims of following cases should not be disclosed during the course of service/ execution:-
Rape;

Death or vegetative state of victim;

Sexual intercourse by husband upon his wife during separation;

Sexual intercourse by a person in authority;
-
Sexual intercourse by employing deceitful means;

Gang rape;
-
Repeat offenders;
-
Offences against women or children.

The Delhi Government and other investigation agency will establish an Electronics Summons Delivery Centre in every police station along with requisite infrastructure, for service of summons through electronic communication.
