The Delhi High Court directed preservation of CCTV footage, an independent medical examination, and detailed reports from jail authorities after a Tihar inmate alleged custodial assault by the Head Warden, denial of medical treatment, and demand for illegal protection money.
Previously, prisoners would have to file their appeals and other applications by preparing them in physical form and sending them to the Court for filing.
“Failure on the part of a government hospital to provide the timely medical treatment to a person in need of such treatment results violation of his right to life guaranteed under Article 21 of the Constitution, as has been done in the instant case.”
The Jharkhand High Court said that a show cause notice specifying grounds for the proposed action is mandatory in order to enable the other party to answer the case before passing blacklisting orders.
