THE MOOT PROPOSITION

The Moot Proposition involves issues surrounding the constitutional validity of the Waqf (Amendment) Act, 2025. The dispute arises from amendments that mandate the inclusion of non-Qadiri members in Waqf Boards, abolition of the provision relating to “Waqf by User”, and grant powers to District Collectors to determine Waqf status and validity. The Petitioner contends that these changes infringe upon the Qadiri community’s rights under Articles 14, 25, 26, 29, and 30 of the Constitution. The Union argues that the amendments are essential for transparency, accountability, and better governance of Waqf properties.
