About Centre for Human Rights and Disability Studies, Himachal Pradesh National Law University, Shimla

The Centre for Human Rights and Disability Studies at HPNLU, Shimla, is built on a simple idea: everyone deserves to live with dignity, respect, and equal opportunities—no matter their abilities or background. People with disabilities often face unfair treatment, especially in areas like healthcare, education, jobs, and access to justice. These challenges can be even more severe in remote or hilly regions like Himachal Pradesh, where access and awareness are limited. This Centre is a space where voices of people with disabilities are heard and valued. It brings together students, teachers, activists, government officials, and community members to talk, learn, and work together on real solutions. The goal is to understand the everyday struggles people face and find ways to make laws, policies, and services more inclusive and fair. Through research, discussions, and training, the Centre will focus on important issues like health, mental well-being, accessibility, privacy, and the right to live with independence and dignity. More importantly, it aims to turn these conversations into action—so that real change happens on the ground.

CONCEPT NOTE

India’s Constitution promises every citizen equality, dignity, and justice. But for a long time, people with disabilities have been left out of this promise in many ways—be it access to education, employment, public spaces, or justice. While laws like the Rights of Persons with Disabilities Act, 2016 and international commitments like the UN Convention on the Rights of Persons with Disabilities (UNCRPD) have created a strong legal foundation, the journey towards real inclusion and equality is far from over. This two-day international seminar focuses on how we can look at disability rights through the lens of the Indian Constitution. It aims to explore how constitutional values like equality (Article 14), non-discrimination (Article 15), equal opportunity (Article 16), and the right to live with dignity (Article 21) can be used to strengthen and protect the rights of persons with disabilities.

The seminar will bring together judges, lawyers, academics, students, policymakers, and activists—both from India and around the world—to discuss how constitutional law can be made more inclusive. It will look at how courts have interpreted disability rights, how policies can be improved, and how India can learn from other countries’ experiences to do better.

Organized by Law Mantra Trust in collaboration with the Centre for Human Rights and Disability Studies, Himachal Pradesh National Law University, Shimla, this event is meant to spark new ideas, encourage critical thinking, and help shape policies that truly empower persons with disabilities. The goal is simple: to make sure the promise of the Constitution reaches everyone, including those with disabilities.

Objectives

The seminar seeks to:

  • To understand how the Indian Constitution—especially values like equality, dignity, freedom, and respect—can help improve laws and policies for people with disabilities.

  • To look at how Indian courts have interpreted disability rights in important cases and how their decisions have helped shape a more inclusive legal system.

  • To bring together experts from different fields—lawyers, judges, teachers, activists, government officials, and persons with disabilities—to talk about the need for disability laws that focus on rights and inclusion.

  • To identify what’s missing in the Constitution when it comes to protecting the rights of persons with disabilities, and to suggest changes that could improve things like access to education, jobs, healthcare, and justice.

  • To learn from how other countries and global human rights frameworks, especially the UN Convention on the Rights of Persons with Disabilities (UNCRPD), approach disability rights and what India can adopt from them.

  • To support research and discussions that lead to practical ideas and suggestions for updating India’s legal system to better reflect both our Constitution and global standards.

  • To create useful academic and policy materials that can help guide future law reforms, court decisions, and advocacy efforts for disability rights in India.
