Hit and Run Victim Compensation

On 2-3-2026, the Ministry of Road Transport and Highways (MoRTH) notified the Compensation to Victims of Hit and Run Motor Accidents (Amendment) Scheme, 2026 revising the scheme to a more structured, transparent, and aligned with emerging digital and administrative requirements.

Key Highlights of Hit and Run Motor Accidents Amendment Scheme:

  1. This amendment updates and restructures the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022.

  2. The amendment revises the terms such as:

    • ‘Fund’ now refers to the Motor Vehicle Accident Fund.

    • ‘GI Council’ replaces ‘General Insurance Council’ aligning with Section 64 C of the Insurance Act, 1938.

    • ‘Portal’ is introduced as a digital platform developed and managed by the GI Council to facilitate electronic submissions and processing.

    • District Road Safety Committee and State Road Safety Council are defined with expanded roles.

  3. The amendment substitutes Paragraph 13 with new detailed structure. District committees will now:

    • Evaluate local implementation and take corrective measures

    • Maintain month wise statistics in electronic form, including pendency reasons

    • Improve awareness among claimants

    • Provide guidance to victims and families

    • Supply required information to state- and national level authorities.

  4. Under newly inserted Paragraph 13A, State councils will:

    • Assessing progress across districts

    • Reviewing statewide monthly electronic statistics

    • Issuing directions to improve scheme implementation

    • Reporting issues to Government or the Standing Committee.

  5. To modernize claim handling, the amendment mandates the use of an electronic portal managed by the GI Council. Applications, enquiry reports, and sanction communications are now required to be processed digitally.

  6. The Claims Settlement Commissioner will be required to sanction claims within 15 days from receiving the Claims Enquiry Officer’s report.

  7. The sanction order will be shared with:

    • GI Council

    • Claimant

    • Claims Enquiry Officer

    • Motor Accident Claims Tribunal

    • Transport Commissioner

    • District Road Safety Committee

  8. The amendment replaces Forms I, II, and III with updated versions:

    Form I now collects:

    • Claimant’s contact details

    • Aadhaar

    • Bank information

    • e Detailed Accident Report (‘eDAR’) references

    • FIR, post mortem/injury report copies

    • Medical officer details

    • Detailed relationship information in death cases.

    • The form now covers three scenarios:

      ○ Grievous injury

      ○ Grievous injury followed by unrelated death

      ○ Death Case due to the accident itself

      Form II and Form III are redesigned to include:

      ○ Application number

      ○ Claimant’s contact

      ○ eDAR Victim ID

      ○ Structured banking details
