Supreme Court: While considering this petition filed by Euro Pratik Ispat (India) Private Ltd., assailing the judgment of Madhya Pradesh High Court whereby the High Court had restored the suit between the parties on the record of the Commercial Court; the Division Bench of J.B. Pardiwala and K.V. Viswanathan, JJ., noted that the long drawn litigation between the parties, which has been murkier and murkier day-by-day could be brought to an end if the parties are persuaded to go for mediation before any Former Judge of the Supreme Court, more particularly considering the nature of the disputes between them and the stakes involved therein.
Therefore, the Court appointed former Chief Justice of India, Dr. D.Y. Chandrachud, to act as Mediator between the parties and resolve the disputes. The Court requested the Mediator to submit his report at the earliest.
The appellant had approached the Supreme Court after being aggrieved with the High Court’s decision whereby it had restrained the appellant herein vis-a-vis transporting and selling of 170,000 MT of iron ore iron ore and deficit quantity of iron ore from its other stock, till the disposal of the application under Order 39 Rules 1 & 2 CPC by the Commercial Court.
The Supreme Court while proposing the alternative of Mediation, given the lengthy litigation between the parties, and thus appointing Justice Dr Chandrachud as Mediator, directed the parties to maintain status-quo. If there are any proceedings pending between the parties, civil or criminal, those proceedings shall remain stayed till the report of the Mediator is received and further orders are passed by the Court.
