Inox India interim injunction Cryogas

Khaitan & Co represented Inox India before the Baroda District Court in securing interim injunctive relief against Cryogas Equipment and others in a suit involving allegations of copyright infringement and breach of confidentiality. This decision marks a significant milestone in a long-standing dispute spanning over seven years.

Following the landmark judgment of the Supreme Court of India in April 2025, which introduced a two-pronged legal test to determine the eligibility of an artistic work for design protection, the Baroda District Court has prima facie held that Inox’s engineering drawings qualify as artistic works and are thus eligible for copyright protection. The Court further found the defendants to be in breach of confidentiality and affirmed that a composite suit is maintainable under Order II Rule 3 of the CPC.

The team comprised Adheesh Nargolkar (Partner), Smriti Yadav (Partner), and Dhiren Karania (Principal Associate), with Counsel Rashmin Khandekar appearing for Inox.
