Waqf Amendment Act 2025

Supreme Court: In a batch of petitions challenging the validity of several provisions of the Waqf (Amendment) Act, 2025 (‘Impugned Act’), the division bench of BR Gavai*, CJI and AG Masih, J. concluded that, in the totality of the circumstances, no case had been made out to stay the provisions of the entire statute. Therefore, the prayer for a stay of the impugned Act was rejected. However, to protect the interests of all parties and balance the equities during the pendency of this batch of matters, the court issued the following directions in relation to the stay on certain provisions of the Amended Waqf Act:

  1. Clause (r) of Section 3:

    The part of Clause (r) in Section 3 of the Amended Waqf Act, which reads “any person showing or demonstrating that he is professing Islam for at least five years”, shall stand stayed until the State Government frames rules to provide a mechanism for determining whether a person has been practicing Islam for at least five years.

  2. Section 3C (Proviso and Sub-sections 3 & 4):

    The proviso to sub-section (2) of Section 3C, which states “Provided that such property shall not be treated as waqf property till the designated officer submits his report,” along with sub-sections (3) and (4) of Section 3C, shall also stand stayed.

    1. Sub-section (3): If the designated officer determines the property to be government property, necessary corrections in revenue records must be made and reported to the State Government.

    2. Sub-section (4): The State Government, upon receiving the report, will direct the Board to make appropriate corrections in the records.

  3. Waqf Property Title and Revenue Records:

    Until the issue regarding the title of waqf property under Section 3C is finally decided by the Tribunal in proceedings initiated under Section 83, and subject to further orders by the High Court, waqfs will not be dispossessed of their property. No changes to revenue records or the Board’s records will be made. Additionally, no third-party rights will be created in such properties during the inquiry under Section 3C, until the Tribunal’s final determination and any appeals.

  4. Central Waqf Council and Board Composition:

    1. The Central Waqf Council, constituted under Section 9, shall not have more than 4 non-Muslim members out of 22.

    2. The Waqf Board, constituted under Section 14, shall not have more than 3 non-Muslim members out of 11.

  5. Appointment of Chief Executive Officer:

    While not staying Section 23 of the Amended Waqf Act, the court directed that, as far as possible, efforts should be made to appoint a Muslim community member as the Chief Executive Officer of the Board, who also serves as the ex-officio Secretary.

The Court clarified that the observations made were based on prima facie considerations for deciding whether an interim stay should be granted. These observations do not prevent the parties from submitting further arguments regarding the validity of any provisions of the Amended Waqf Act.

Background

The petitions challenged the provisions of the Waqf (Amendment) Act, 2025, on the grounds that they were ultra vires the Constitution of India, violating Articles 14, 15, 19, 21, 25, 26, 29, 30, and 300A. While the petitioners sought to challenge the constitutionality of nearly all sections of the impugned Act, the primary challenge focused on the amendments made to Sections 3(r), 3C, 3D, 3E, 9, 14, 23, 36, 104, 107, 108, and 108A of the Unified Waqf Management, Empowerment, Efficiency, and Development Act, 1995 (‘Amended Waqf Act’).

Analysis and Decision

On the scope of granting interim relief, the Court stated that the courts should be very slow in granting interim relief by way of staying the provisions of an enactment. Such interim relief can only be granted in rare and exceptional cases, where the parties are able to show that either the legislature lacked the competence to enact the law, or the provisions are ex-facie in violation of any provisions in Part III of the Constitution, constitutional principles, or are manifestly arbitrary.

To examine whether the petitioners had made out a strong case regarding the amendments introduced to the Old Waqf Act by the impugned Act, the Court reviewed the legislative history of various enactments that regulate and govern the creation of waqfs. This examination was crucial in determining whether the amendments were beyond the legislative competence of Parliament, or whether they ex-facie violated any provisions of Part III of the Constitution, constitutional principles, or were manifestly arbitrary.

The Court examined the legislative history of the following Waqf enactments to consider the question of whether the impugned Act deserves to be stayed:

  1. Mussalman Wakf Act, 1923

  2. Bengal Wakf Act, 1934

  3. Wakf Act, 1954

  4. Wakf Enquiry Committee & Wakf (Amendment) Act, 1984

  5. Waqf Act, 1995

In this context, the Court analysed the evolution of these statutes and their impact on the administration and regulation of Waqf properties.

The Court emphasised the well-established principle that there is a presumption in favor of the constitutionality of an enactment. The burden of proof lies with the party challenging the legislation to demonstrate a clear violation of constitutional principles. The Court noted that it is settled law that the legislature, being closer to the needs of its people, understands and addresses issues grounded in real-world experience. Laws enacted by the legislature are assumed to be grounded in reasonable discrimination, and the legislature is free to recognize varying degrees of harm and apply its restrictions to cases where the need is most pressing.

Furthermore, the Court highlighted that a statute enacted by Parliament or a State Legislature cannot be declared unconstitutional lightly. To do so, the court must be convinced beyond any doubt that the violation of constitutional provisions is so glaring that the legislative provision in question cannot stand.

In light of this legal framework, the Court proceeded to examine whether the petitioners had established a strong prima facie case for staying the entire statute, i.e., the impugned Act.

a. Section 4(ix)(a) of the impugned Act: Waqf can be created only by a person showing or demonstrating that he is practicing Islam for at least 5 years

The Court noted that one of the sections challenged by the petitioners is the amendment to Section 3(r) of the original Waqf Act, introduced by Section 4(ix)(a) of the impugned Act. In this regard, the Court found it appropriate to refer to Section 3(r) of the Amended Waqf Act.

Prima facie, the Court observed that such a provision could not be considered arbitrary or discriminatory. The Court explained that as early as 1923, the legislature had recognised that Waqf endowments were often perceived by the public as a “clever device” to tie up property in a manner that could defeat creditors and evade legal obligations, under the guise of a plausible dedication to the Almighty.

The Court further noted that the possibility of individuals who are not part of the Muslim community converting to Islam for the sole purpose of benefiting from the protections of the Waqf Act, thus using it to evade creditors and the law, could not be ruled out. This concern, rooted in historical legislative awareness, justified the amendments made to Section 3(r) to prevent such potential misuse, in the Court’s view.

The Court expressed its prima facie view that the provision requiring a person to demonstrate practicing Islam for at least five years before creating a waqf could not be considered arbitrary. The Court observed that this requirement had a clear nexus with the objective sought to be achieved by the Waqf Act, as it was intended to prevent misuse of the law by individuals who may convert to Islam solely to benefit from Waqf protections.

However, the Court highlighted an important issue: no mechanism or procedure had yet been established to determine whether a person had been practicing Islam for the required five years. Given the absence of such a mechanism, the Court concluded that the provision could not be implemented immediately.

Therefore, the Court considered that unless the Central Government enacts the necessary rules under its rule-making powers under Section 109 of the Amended Waqf Act, the provision in Section 3(r), which requires a person to demonstrate having practiced Islam for at least five years in order to create a waqf, could not be enforced.

b. Section 4(ix)(b) of the impugned Act: Deletion of the clause concerning “Waqf by User” i.e., clause (i) of Section 3(r) of the Original Waqf Act.

The Court observed that if the Mutawallis had failed to apply for registration over a span of 30 years, they could not now challenge the provision requiring the application to be accompanied by a copy of the waqf deed as being arbitrary. The Court further noted that if the legislature, in response to the misuse of waqf properties, decides that all future applications must include a copy of the waqf deed, such a provision cannot be regarded as arbitrary.

The Court also highlighted that if, in 2025, the legislature takes steps to address the encroachment of government properties through the concept of “Waqf by User” and decides to abolish the provision, it prima facie cannot be considered arbitrary.

In light of such instances of misuse, the Court found that if the legislature decides to abolish the concept of “Waqf by User” prospectively, it could not prima facie be considered arbitrary. The Court further clarified that the deletion of clause (i) of Section 3(r) of the Original Waqf Act would only take effect from the date the impugned Act came into force, and therefore, it would not apply retrospectively. Consequently, the Court rejected the petitioners’ contention that lands vested in waqfs would be seized by the government, stating that this argument prima facie held no merit.

c. Section 5 of the impugned Act (Section 3C of the Amended Waqf Act): Wrongful declaration of waqf.

The Court noted that sub-section (1) of Section 3C of the Amended Waqf Act stipulates that any Government property identified or declared as waqf property, before or after the commencement of the Act, shall not be deemed to be waqf property. The Court emphasised that government property is held in trust for the citizens of India and any wrongful possession of such property cannot be allowed to be claimed as private property. Sub-section (2) of Section 3C provides that if any dispute arises regarding whether a property is government property, the State Government may designate an officer above the rank of Collector to inquire into the matter and submit a report. Until this inquiry is completed, the property shall not be treated as waqf property.

The Court observed that a provision requiring the designation of a senior officer to investigate whether a property is government property, and to report to the State Government, prima facie cannot be considered arbitrary. However, the Court expressed concerns about the proviso to sub-section (2), which stipulates that the property cannot be treated as waqf property until the designated officer submits his report. The Court found this provision to be prima facie arbitrary, as it would render property not recognized as waqf property before the determination of its status as government property, which could potentially be unjust.

Further, the Court considered sub-sections (3) and (4) of Section 3C. Sub-section (3) directs the designated officer, if he finds the property to be government property, to make necessary corrections in the revenue records and submit a report to the State Government. Sub-section (4) mandates the State Government to direct the Board to make the appropriate corrections based on the officer’s report.

While the Court upheld the general provisions of Section 3C(1) and 3C(2) prima facie, it expressed concerns about the question of determining property title being entrusted to a revenue officer, as it might conflict with the principle of separation of powers under the Constitution. Determining the title of a property, the Court reasoned, should not fall under the jurisdiction of a revenue officer, and such decisions must be in line with constitutional principles. The question of determination of the title of a property will have to be resolved by a judicial or quasi- judicial authority.

The Court viewed that the provision allowing necessary corrections to be made in the revenue records after the conclusion of the inquiry, along with the provision enabling the State Government to direct the Board to make appropriate corrections upon receiving the report, prima facie appears arbitrary and is liable to be stayed.

However, to balance the equities and protect valuable government properties, the Court emphasised the need to ensure that, pending the determination by the Tribunal, the Mutawallis (custodians of waqf properties) do not create any third-party rights over the properties in question. This applies to properties for which proceedings under Section 3C of the Amended Waqf Act have been initiated, and such actions should not occur until the final adjudication by the Tribunal is made.

d. Section 5 of the impugned Act (Section 3D of the Amended Waqf Act): Declaration of protected monument or protected area as waqf to be void.

The Court noted that the Ancient Monuments Preservation Act, 1904 and the Ancient Monuments and Archaeological Sites and Remains Act, 1958 (collectively referred to as the “Ancient Monuments Acts”) have been enacted with the explicit purpose of protecting ancient monuments. These monuments form an integral part of the country’s cultural heritage and, therefore, require safeguarding and preservation.

The Court concluded that it did not find any case to stay the said provision

e. Section 5 of the impugned Act (Section 3E of the Amended Waqf Act): Bar of declaration of any land in Scheduled or Tribal area as waqf.

The Court observed that Section 3D of the Amended Waqf Act, which prohibits land belonging to members of Scheduled Tribes under the Fifth and Sixth Schedules of the Constitution from being declared or deemed to be waqf property, is a provision enacted with the specific aim of protecting one of the most marginalized and vulnerable sections of society, the Scheduled Tribes. Given that the Fifth Schedule empowers the Governor to regulate or restrict the transfer of land within these areas, the Court concluded that such a provision has a clear nexus with its intended objective of safeguarding the interests of Scheduled Tribes. Consequently, the Court determined that this provision could not be considered prima facie arbitrary, and thus, no grounds existed to stay it.

F. Sections 10, 12, and 16 of the impugned Act: Sections 9 and 14 of the Amended Waqf Act

The Court said that it did not wish to delve into the issue of whether the inclusion of non-Muslim members in the Central Waqf Council or the Board could be construed as interference in religious practices at this stage. However, the Court noted that the Solicitor General had made a categorical assurance that the number of non-Muslim members in the Central Waqf Council, as provided under Section 9 of the Amended Waqf Act, would not exceed four, and that the number of non-Muslim members in the Waqf Board, as provided under Section 14, would not exceed three.

To eliminate any potential ambiguity, the Court directed that the Central Waqf Council should not have more than four non-Muslim members, and the Waqf Board should not have more than three non-Muslim members.

g. Section 23 of the Amended Waqf Act: Appointment of Chief Executive Officer and his term of office and other conditions of service.

The Court, upon perusing clause (e) of sub-section (1) of Section 14 of the Amended Waqf Act, observed that one of the ex-officio members of the Waqf Board must be a Joint Secretary to the State Government dealing with Waqf matters. Additionally, the Chief Executive Officer (CEO) of the Board, who is also the ex-officio Secretary, would be an officer of the State Government, and would typically hold the position of Joint Secretary in charge of Waqf matters.

It was further noted that, ordinarily, the person holding the position of CEO would be a Muslim. The Court clarified that even if the ex-officio Secretary of the Board happens to be a non-Muslim, this would not impact the functioning of the Board. Given that the Board consists of 11 members, with a majority (8 or more) being Muslim, the decision-making process would be controlled by the Muslim members. Therefore, the Court concluded that there was no prima facie case for staying this provision.

However, the Court added that, as a matter of practice, an effort should be made to appoint a Muslim individual as the Chief Executive Officer at the earliest possible opportunity to align with the overall composition of the Board.

h. Section 21 of the impugned Act: Section 36 of the Amended Waqf Act

The Court, in its analysis of sub-section (10) of Section 36 of the Amended Waqf Act, noted that the Statement of Objects and Reasons of the original 1923 Act highlighted the misuse of Waqf provisions to evade legal proceedings and deny creditors their claims. This historical context was important as it laid the groundwork for the introduction of measures designed to prevent the abuse of Waqf properties, specifically to safeguard against the actions of Mutawallis who attempted to avoid legal accountability.

The Court pointed out that the Waqf Enquiry Committee, appointed by the Central Government in 1969-70, had recommended the inclusion of provisions similar to Section 55E of the Bombay Public Trusts Act, 1950, to address these issues. While a similar provision was also proposed under the Waqf (Amendment) Act, 1984, it had not been brought into effect. Thus, the Court found that such provisions were neither discriminatory nor arbitrary but were necessary for maintaining parity with other public trust laws.

The Court further referred to the existence of a similar provision (Section 87) under the original Waqf Act from 1995 to 2013, which was later deleted. This reflected the continuity of efforts to address the misuse of Waqf properties and the need for better legal safeguards.

Regarding the specific timeline provided under sub-section (10), the Court noted that the provision allows a period of six months from the commencement of the impugned Act for Waqfs to get themselves registered. Additionally, the proviso to sub-section (10) allows for the extension of this period if sufficient cause is shown. The Court, therefore, concluded that this provision was not arbitrary or discriminatory but rather aimed at ensuring proper registration and legal accountability of Waqf properties.

i. Section 43 of the impugned Act

The Court, in its conclusion regarding the deletion of Section 104 of the Original Waqf Act, observed that the amendment was introduced to align with the definition of waqf as per Section 3(r) of the Amended Waqf Act. Section 3(r) stipulates that a waqf can only be created by a person who can demonstrate that they have been practicing Islam for at least five years.

Given that context, the Court found that the deletion of Section 104 was not arbitrary

j. Section 44 of the impugned Act: Section 107 of the Amended Waqf Act: On and from the commencement of the impugned Act, Limitation Act, 1963 shall apply to any proceedings in relation to any claim

The Court, in its analysis, addressed the applicability of the Limitation Act, 1963 to claims or interests concerning immovable property within a waqf. The petitioners had challenged this provision, but the Court stated that it could not understand how the application of the Limitation Act to waqf property claims could be considered arbitrary.

In fact, the Court noted that this provision actually removes discrimination that was present in the unamended Waqf Act, as the earlier law may have treated waqf property claims differently from other immovable property claims under the Limitation Act. By making the Limitation Act applicable to waqf properties, the Court emphasized that it ensures consistency and fairness in legal proceedings related to waqf property.

Given this reasoning, the Court concluded that the petitioners had not made a prima facie case for staying the provision and that the application of the Limitation Act to waqf property claims was a rational and non-arbitrary legislative measure.

k. Section 45 of the impugned Act

The Court, while considering Section 108A of the Original Waqf Act, highlighted that this provision, which gave the Waqf Act an overriding effect, was only inserted by an amendment in 2013 (Act 27 of 2013) and came into force on 1st November 2013. Prior to that, the Waqf Act did not contain such a provision. Thus, Section 108A had only been part of the statute for a brief period, around 11 years, and was not present from 1995 to 2013.

The Court emphasized that while the legislature is empowered to enact provisions, it is equally within its competence to amend or delete provisions as it sees fit. As such, the Court found no prima facie substance in the challenge to the deletion of Section 108A under the impugned Act.

In summary, the Court concluded that the legislature had the authority to bring in and remove provisions as necessary, and therefore, there was no merit to the challenge regarding the deletion of Section 108A.
