Supreme Court: In a matter concerning a unique issue regarding the role of Court Managers, who were introduced by the Thirteenth Finance Commission (2010-2015) to improve the efficiency of court management, the objective was to provide administrative support to judges, ultimately leading to enhanced case disposal, the three Judge Bench of BR Gavai*, CJI, Augustine George Masih and K. Vinod Chandran, JJ. issued the following directions:
(i) High Courts to frame or amend rules: All High Courts in the country shall frame or amend the rules concerning the recruitment and conditions of service for Court Managers. They must take the Assam Rules of 2018 as the model and submit them to the respective State Governments for approval within three months from the date of this judgment. The High Courts and State Governments are free to make suitable modifications to accommodate their specific needs.
(ii) State Government approval: Upon receipt of the rules framed or amended by the High Courts, the respective State Governments shall finalize and grant approval within three months.
(iii) Minimum rank/class of Court Managers: The minimum rank/class of Court Managers should be of a Class-II Gazetted Officer, which would apply to their basic pay, allowances, and other service benefits.
(iv) Supervision of Court Managers: Court Managers appointed in the High Courts will work under the directions and supervision of the Registrar General/Registrars of the High Courts. In the case of Court Managers appointed in the District Courts, they shall work under the supervision and control of the Registrars/Superintendents (Head of the Ministerial Staff) of the courts concerned.
(v) Clear delineation of duties: The Rules Committee of the High Courts shall ensure that the duties, functions, and responsibilities of Court Managers do not overlap with those of the Registrars of the High Courts or District Courts.
(vi) Regularisation of existing Court Managers: Court Managers who are already working on a contractual or consolidated pay basis or on an ad hoc basis shall have their services continued and regularized, subject to passing a suitability test, as provided in the rules to be framed by the respective High Courts and approved by the respective State Governments.
(vii) Entitlement to regularisation: Court Managers already working will be entitled to regularisation from the date of their initial appointment. However, they will not be entitled to arrears for the period between their initial appointment and their actual regularisation.
(viii) Timeline for regularisation: The process of regularisation for Court Managers shall commence and be completed within three months from the date of approval of the rules by the respective State Governments.
(ix) Responsibility of officials: The respective Registrar Generals of the High Courts and the Chief Secretaries of the State Governments shall be personally responsible for adhering to the above-mentioned timelines.
Background
The concept of “Court Managers” was first proposed by the Thirteenth Finance Commission (2010-2015). The Commission had recommended the creation of the post of Court Managers with the aim of assisting judges in performing their administrative duties. It was proposed that the Court Managers be appointed at both the District Court/Sessions Court level and the High Court level. The Court further observed that the Commission had estimated and allocated the necessary funds for the remuneration and other expenses that would be incurred by the States for appointing such Court Managers.
After the Report of the Thirteenth Finance Commission, ‘Guidelines for release and utilization of Grant-in-aid for the Improvement in Justice Delivery as recommended by the Thirteenth Finance Commission’ (Guidelines’) came to be issued by the Ministry of Finance which recommended the roles, responsibilities and the qualifications of Court Managers in detail.
Judgment of the Court in the proceedings dated 2-08-2018
In All India Judges’ Association v. Union of India, (2018) 17 SCC 555, wherein the Court, gave directions regarding the necessary constituents of a “Court Complex”. As a part of the discussion of efficient dispensation and the accessibility to justice for the litigants, the role and importance of Court Managers was also discussed. A direction was also given that Court Managers who are already working must be regularized by the State Government as their assistance was found necessary for a proper administrative setup in the courts.
Report of the SNJPC
In its comprehensive report, the SNJPC addressed various aspects of judicial administration, including the role of Court Managers. The SNJPC recognized the crucial importance of professional management in courts to enhance efficiency and reduce the administrative burden on judges. It recommended the appointment of Court Managers to handle non-judicial functions, thereby allowing judges to focus on their core judicial responsibilities. The SNJPC also analyzed the remuneration and employment status of Court Managers in various states, including Telangana, Maharashtra, and Rajasthan, where the Court Managers continued to work either on a consolidated pay or on a contractual basis. The Report acknowledged the Gauhati High Court (Appointment and Conditions of Service of Court Managers for the State of Assam) Rules, 2018, as comprehensive rules that regularized the Court Managers, providing them with pay benefits and an annual increment.
After the recommendations of the Thirteenth Finance Commission, the SNJPC Report, and the judgment of this Court in the present proceedings dated 2-08-2018, it was expected that the High Courts across the country would frame rules for Court Managers and that the State Governments would approve the same. However, upon reviewing the affidavits submitted by the various State Governments and the High Courts, it was observed that some High Courts had finalized the rules for Court Managers, which had been approved by their respective State Governments. In contrast, the rules prepared by some High Courts were still pending approval from the State Governments concerned. Furthermore, a few High Courts had yet to even frame the rules. As a result of these delays and discrepancies, the present batch of IAs, along with the Writ Petition, had been filed before this Court.
The applicant sought directions to bring uniformity and enhancement in the service conditions of Court Managers across India. The applicant had requested a higher pay scale with appropriate allowances as recommended by the Second National Judicial Pay Commission (‘SNJPC’). The applicant also sought recognition of Court Managers as Class I Gazetted Officers, the regularisation of those still on a contractual basis, and the consideration of their past continuous service for pensionary and monetary benefits. Furthermore, the applicant had prayed for directions from the Court that would lead to the framing of uniform rules for career progression and promotions, along with the formulation of a structured duty roster outlining their roles, responsibilities, and delegated authority to ensure efficient judicial administration.
Issue
Whether in light of the Thirteenth Finance Commission, SNJPC Report and the judgment of this Court in the present proceedings dated 2-08-2018, any further direction needs to be issued to various High Courts and State Governments for framing and implementation of rules for the Court Managers.
Analysis and Decision
The Court observed that although the Guidelines had elaborately addressed various aspects concerning the duties of Court Managers, most High Courts had not framed any formal rules and had instead appointed Court Managers only on a contractual or ad hoc basis.
The Court expressed its deep concern, stating that it was pained to note that despite the clear recommendations made by the SNJPC and the specific directions issued by this Court in its judgment dated 2-08-2018 in the present proceedings, many High Courts and State Governments had yet to comply with the mandate to frame rules governing the service conditions, duties, and other aspects of Court Managers.
The Court further observed that, notwithstanding its earlier directions to regularise individuals already working as Court Managers, a significant number of them continued to be employed either on a contractual or ad hoc basis. Not only had the issues of regularisation, allowances, benefits, and career progression remained unaddressed, but it was also brought to the Court’s attention that in some States, authorities had gone so far as to decide to discontinue the services of Court Managers altogether. Certain State Governments have even resolved to abolish the post of Court Managers, citing financial constraints as the reason.
The Court viewed that since it has consistently emphasisd the need for uniformity in the service conditions of judges across the country, it is equally important that the system for providing Court Managers to the courts, designed to enhance the efficiency of the administration of justice should also be implemented uniformly across the nation. The Court stressed that such uniformity is crucial to ensuring consistency and effectiveness in judicial administration throughout India.
The Court observed that it has already emphasised the importance of Court Managers in assisting District Judges with administrative tasks, allowing judges to focus on their core function of adjudicating cases. In light of this, the Court deemed it imperative to reiterate its earlier directions, urging that the rules regarding the service conditions of Court Managers be framed and approved in a time-bound manner to ensure effective implementation and consistency across the judicial system.
After perusing the Assam Rules of 2018, the Court noted that the Rules provide for the regularisation of the services of Court Managers and outline the associated benefits and allowances. The Rules further specify the method of recruitment and the training required for Court Managers. Most importantly, the Court highlighted that the Assam Rules also clearly enumerate the various duties and responsibilities entrusted to the Court Managers, ensuring a structured approach to their role in enhancing the efficiency of judicial administration.
Thus, the Court concluded that the Assam Rules of 2018 clearly outline the role of Court Managers in assisting the Registrar General and the District Judges. Additionally, Schedule-I of the Assam Rules of 2018 provides an in-depth description of the duties and responsibilities of Court Managers. These duties align broadly with the recommendations of the Thirteenth Finance Commission, while also incorporating other tasks as needed by the High Court or the District Courts. In light of this, the Court agreed with the SNJPC Report, which recognized the Assam Rules of 2018 as being comprehensive in their scope.
The Court stated that, as with other services, promotional avenues are necessary for employees who join the base position of “Court Manager.” Stagnation at a particular level would reduce the efficiency of such Court Managers. The availability of promotional opportunities would lead to better performance and enhanced efficiency. Alternatively, the High Courts and State Governments should consider providing a scheme for Assured Career Progression (‘ACP’) within the rules to incentivize the Court Managers’ performance.
The Court further opined that the Assam Rules of 2018 should be considered as a model for other High Courts when framing their own rules. It was emphasised that the High Courts and State Governments could make adjustments and modifications to accommodate any peculiar exigencies specific to their respective jurisdictions.
The Court found that the directions issued in its judgment dated 2-08-2018, regarding the regularisation of the services of the Court Managers already in employment, need to be reiterated. The Court observed that after having rendered their services for many years, if these Court Managers are not made permanent and are dismissed at this stage, it would cause significant hardship to them. The Court also agreed with the submission of the amicus curiae that, in order to separate the unsuitable candidates, a suitability test should be conducted. This would ensure that only those Court Managers who are found to be suitable would continue, while those deemed unsuitable could be discontinued. The Court further stated that rules for this process should be formulated accordingly.
