“A bare perusal of the Patta reflects that the land in question was sold out for Rs.312 to Baijnath and Sargarmal in the year 1916. The said Patta nowhere reflects that the land was sold out at a concessional rate. Further, there is no stipulation in the said Patta regarding its user.”

The Court opined that the impugned orders resulted in a situation where the Department has been forced to continue with two employees on the same post and this situation cannot be permitted to be continued.
The Court advised the State of Rajasthan to amend the Motor Driving School Registration Scheme, 2018 to include provisions for license transfer to legal heirs.
“Order of priority hearing, if granted, place a class of litigants, who move the Court in a separate and preferential category whereas other cases which may be of similar or great antiquity and urgency are left to be decided in the normal channel.”
The petitioners alleged that the objections were decided without affording them a proper opportunity of hearing, relying solely on a newspaper notice.
