“Although this Court recognizes that police personnel also have the right of private defense and may use force in appropriate circumstances, it is well settled that where death occurs or grievous injuries are caused to the accused, the procedure mandated by the Supreme Court must be strictly followed.”
In a case pertaining to cyberfraud of Rs. 2,02,00,000 through digital arrest, the High Court issued sweeping directions to Additional Chief Secretary, Home, Director General of Police , Director General, State Crime Record Bureau and Cyber for issuance of necessary notifications, circulars, standard operating procedure etc., to handle the issue of rising cybercrime in State of Rajasthan.
The Court questioned the authorities as to why the initial FIR was lodged only against the former Secretary and the recovery proceedings were referred to the joint secretary who had no authority.
The Court was confounded, and its conscience shaken by hearing the evasive and false replies of the Police Head Constable; his demeanour clearly indicated his interest in protecting the accused than the victim of the sexual assault.
