Madhya Pradesh High Court: In a writ petition filed by Congress MLA Umang Singhar against BJP MLA Nirmala Sapre seeking her disqualification from the Legislative Assembly, the Division Bench of Sanjeev Sachdeva, CJ., and Vinay Saraf, J., issued notices to the Speaker of Madhya Pradesh Legislative Assembly (“the Speaker”) and Nirmala Sapre.
Umang Singhar filed the present writ petition since his petition that he had filed before the Speaker on 30-06-2024 seeking the disqualification of Nirmala Sapre had not yet been decided.
He contended that the Speaker had to decide his petition as expeditiously as possible, and a period of three months had been laid down by the Supreme Court in Keisham Meghachandra Singh v. Speaker, Manipur Legislative Assembly, (2021) 16 SCC 503.
The State contended that the Court cannot exercise the power of judicial review except in a case where the Speaker has decided on the petition, and in the first instance, it is the absolute prerogative of the Speaker of the Legislative Assembly to adjudicate such a petition.
Accordingly, the Court issued notice to the Speaker and MLA Nirmala Sapre.
