Supreme Court temporarily allows Ajit Pawar faction to use Clock symbol for elections; Directs ECI to recognise Sharad Pawar with new symbol

Supreme Court: In a plea filed by Sharad Pawar challenging a decision of the Election Commission of India (‘ECI’) to grant the clock party symbol to his nephew Ajit Pawar and recognise his group of Member of Legislative Assembly(‘MLA’) as the real Nationalist Congress Party (‘NCP’), the two-judge bench of Surya Kant and KV Viswanathan, JJ. has temporarily permitted Ajit Pawar faction of the NCP to use the party’s clock symbol for the upcoming Parliamentary and Maharashtra State elections, with certain conditions. Further, it also directed ECI to provisionally recognise Sharad Chandra Pawar’s faction of the NCP as a political party for contesting upcoming parliamentary and State elections with the symbol of a man blowing a trumpet.

The Bench directed Ajit Pawar faction to issue a public notice in newspapers with English, Hindi and Marathi editions, notifying that the allocation of clock symbol is sub-judice before Supreme Court and they have been permitted to use the same subject to final outcome of these proceedings. Further, the incorporation of such a disclaimer in every advertisement and audio and video clips to be issued on behalf Ajit Pawar faction of the NCP.
