[Money Laundering] Supreme Court constitutes 3 Judge Bench to hear review against Vijay Madanlal Judgment

Supreme Court: A three Judge Bench comprising of Sanjay Kishan Kaul, Sanjiv Khanna and Bela M. Trivedi has been constituted to hear the review petitions against the landmark judgment in Vijay Madanlal Choudhary v. Union of India, 2022 SCC OnLine SC 929 , wherein the Court upheld the validity of certain impugned provisions of the Prevention of Money Laundering Act, 2002 (‘PMLA’) by holding that the same have reasonable nexus with the object sought be achieved i.e. combatting the menace of money laundering.

The Bench will be hearing the matter from 18-10-2023.

Previously, the division bench of Rohinton Nariman and Sanjay Kishan Kaul, JJ. had struck down Section 45(1) of the PMLA to the extent it imposed two additional conditions for grant of bail to money laundering accused and held that the twin conditions were arbitrary and discriminatory.

However, this decision was overruled by a full bench of AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar, JJ. in the case of Vijay Madanlal Choudhary (supra).

Due to criticism of the ruling, several review petitions were filed, which will now be heard by the three-judge bench.
