NALSAR announces Certificate Programme in Advanced Air Laws

About Centre for Aerospace & Defence Laws (CADL)

The main objectives of the University is to evolve and impart comprehensive legal education at all levels to achieve excellence and to organize advanced studies and promote research in all branches of law. Towards achieving its objectives the University has established advanced research centres to offer courses on contemporary areas, to undertake research, to organize lectures, seminars, conferences, workshops and to publish articles, books, newsletter and journals etc., for dissemination of knowledge. The Centre for Aerospace & Defence Laws has been continuously promoting the study of aerospace and defence laws by offering Masters and PG Diploma programmes on aviation, space, telecommunication, GIS, Remote Sensing Laws, Defence and Security Laws etc. and also by organizing seminars / conferences and by publishing newsletters and journals. To give an opportunity to the interested group to gain knowledge on the contemporary areas of aerospace and defence laws, the Centre for Aerospace & Defence Laws (CADL) proposes to offer short term certificate courses in areas like air law, space law, telecom laws, defence laws etc.

Content of the Programme

The Certificate Programme on Advanced Air Laws will cover the following areas:

Module I – General Principles of Law

It is a well-known legal maxim ‘ignorantia juris neminem excusat’which means that ‘ignorance of law is no excuse’. With the growing complexities in the nature of a society, legal awareness is of utmost importance as it helps the participant to understand the rights they are entitled to and the obligations they have as a responsible citizen of the country. Hence the first module of the programme deals with a fundamental discussion on the ‘General Principles of Law’ which is designed with the intention of providing the course participants with an overall understanding of the fundamental concepts and principles of law and also develop an in- depth base on the functioning of law in government, society and our lives.

Module II- International Air Law

With the taking off of the first manned flight way back in 1903, the advent of international aviation began setting the stage for a number of additional conferences aimed at regulating international airtransport and consequently leading to the Chicago regime. With these emerging issues it was of paramount importance to begin our second module with a discussion around the International Air Law wherein we will be looking into the international air law regime with a special and in-depth focus on Chicago Conference, Bilateral Air Transport Agreements and ICAO and other international aviation organization. With the increasing globalization of economies, liberalization of aviation policies, new technological developments in civil aviation, privatization of airlines and airports, and liberal and open “open skies” bilateral agreements, are some of the new trends emerging on the horizon and the same will be discussed in this module.

Module III – Global Air Safety, Security and Liability Laws

With the advent of the international air transport, one of the first and foremost concern that the regulatory regimes across the globe faced was to ensure adequate safety and security of both the passengers as well as the crew members. A regime that developed in the midst of the Second World War and subsequently the cold war and during the time where technology was also in its nascent stages of development, the only solution with the regulators was to ensure adequate legal protection to the abovementioned sections.

Given the significance of the subject in the arena of international aviation a module on Global Air Safety, Security and Liability Laws has been designed. The module traces the development of global air safety regulations and in particular gives a special focus on the role of ICAO. It thereupon traces the International Aviation Safety and Security Conventions and gradually shifts its focus on the International Aviation Liability regime. The final segment of the module seeks to provide the participants with an in-depth understanding of the dispute settlement mechanism in the aviation liability regime.

Module IV – Domestic Air Laws in India

Aviation is one of the few areas which developed very early prior to the independence. India is perhaps one of the most progressive countries as far as development in the civil and general aviation is concerned. The legal regulatory regime governing the civil aviation sector in India developed way back in 1934 with the advent of the Aircraft Act of 1934 and subsequently the Aircraft Rules of 1937. However, the safety, security and liability regime have developed in the past few decades.

Hence, in this regard our discussion from International Air Law will subsequently venture into the Indian Legal framework governing civil aviation. The paper hence undertakes an in-depth study of the domestic air laws in India and begins by focusing on the Aircraft Act 1934 and the Aircraft Rules of 1937 and key policies developed in the recent past in the civil aviation sector.

Conduct of the Programme

The programme will be conducted for five days. The first four days will have four teaching sessions of two hours each. The examination will be conducted on the closing day in the morning session and certificates will be awarded to the eligible candidates in the afternoon session on the last day.

Pattern of the Exam

Written examination will be conducted at the end of the programme. The paper will have multiple choice questions for 100 marks.

Award of the Certificate

The course completion certificate will be awarded to the candidates who secure a minimum of 50% marks in the test. Candidates who fail to secure the minimum required marks will be given a certificate of participation.

Eligibility

Bachelor’s Degree or an equivalent Degree in any discipline from any recognized University (or) 3-year Degree/Diploma in Aircraft Maintenance Engineering (AME) (or) Students who have completed three years of their 5-year integrated LL.B. Degree programme in Law

Programme Fee

Students : Rs. 6,000; others :Rs. 8,000

Study material, Breakfast, Refreshments during the break and Lunch will be provided to all the participants.

Accommodation

Limited Accommodation is available on campus and will be provided on twin sharing basis only. Those who need accommodation needs to indicate the same in the application form. The charges are as follows:

Hostel Rooms (Non A/c): Rs. 300/- per day per person including Dinner Charges
Air Conditioned Rooms:   Rs. 850/- per day per person including Dinner Charges

Reporting Time : February 7, 2018, 4:00 p.m. onwards

Leaving Time : Before 5:00 p.m. February 13, 2018

Availability : Hostel – 22 Rooms and Air Conditioned Rooms -20 Rooms
