Punjab and Haryana High Court

Punjab and Haryana High Court

Punjab and Haryana High Court: In a writ petition seeking directions regarding implementation of the Court’s directions to curb noise pollution, the petitioner particularly being aggrieved by the loud noise from nearby Gurudwara in the residential area, the Division Bench of GS Sandhawalia and Lapita Banerji, JJ. impleaded the State of Punjab seeking its report regarding whether the decision in Reet Mohinder Singh v. State of Punjab, 2019 SCC OnLine P&H 7001 was being implemented.

The petitioners in the instant matter were aggrieved by the ‘indiscriminate use of loudspeakers at excessive and intolerable volume by a Gurudwara’ in the residential area, such noise allegedly affecting health of the petitioners as well as other people living in the vicinity.

It was alleged that since 2019, the petitioner had been approaching the authorities concerned requesting for prompt action, who in turn remained oblivious to such ‘significant issue of environmental damage’, but no efforts were made.

The Court directed states of Punjab and Haryana to submit status reports by the next date of hearing regarding the number of complaints received as well as action taken on them in all districts of those states.

The matter was adjourned to 22-04-2024 for the next hearing.
