CAN Foundation | Justice Sanjay Kishan Kaul & Senior Advocate Dhruv Mehta to speak on “Dissents That Made A Difference: India & Abroad”

Gujarat National Law University, Gandhinagar in collaboration with Confederation of Alumni for National Law Universities (CAN Foundation) is all set to host an Online Lecture with Justice Sanjay K. Kaul, Judge, Supreme Court of India &Mr. Dhruv Mehta, Senior Adv., Supreme Court of India & Patron on Board, CAN Foundation. The Panelists shall be shedding light on “Dissents That Made a Difference: India & Abroad”. The lecture is scheduled for 5th September, 2020 i.e. Saturday at 5:00 PM. 

Being a part of the Landmark Judgement which ruled Right to Privacy as a fundamental right, Hon’ble Mr. Justice Sanjay Kishan Kaul has played a crucial role in the watershed movement in the history of Constitutional Jurisprudence. He has also served as the former Chief Justice of Madras High Court and Punjab & Haryana High Court. The Co-panelist, Mr. Dhruv Mehta, after studying law at the eminent Campus Law Centre, Delhi, did his LLM from Cambridge University, U.K. on ODA scholarship. 

The Session will be marked by a thorough discussion on:

    1. Landmark dissenting opinions over the years in India by distinguished Hon’ble Justices Fazal Ali, Vivian Bose, Bijan Kumar Mukherjea, K. Subba Rao, A.N. Ray, H.R. Khanna, and D.Y. Chandrachud (Aadhar Matter).
    2. Expansion of the “Due Process Clause” during the Lochner Era in the US particularly the dissenting opinions by Justices M. Harlan, Edward D. White, William R. Day, and Oliver W. Holmes Jr.
    3. Landmark dissenting opinions that led to important developments in the American Constitutional Arena by Justices Harlan, Oliver W. Holmes Jr., Brandeis, and Atkin.
    4. Dissent of American Courts relating to Same-Sex Marriages and LGBTQ+ Rights by C.J. Roberts and Justices Scalia, Thomas, and Altio.

Apart from highlighting the significance of such dissenting opinions, the Panelists would also trace the background and the majority opinion of the cases at hand. The attendees of the session will also be informed about the final outcome of the opinions and their standing in the present scenario.

The Moderators for the session will be Ms. Anupama Dhruve, Adv., Supreme Court of India and Mr. Kanu Agrawal, Adv., Supreme Court of India. Both Ms. Dhruve and Mr. Agrawal are Alumni of NLIU, Bhopal with commendable experience in the field of litigation before the Supreme Court of India, Delhi Court and several other Tribunals of the country.

The Welcome Address shall be delivered by Prof. (Dr.) S. Shanthakumar, Director, GNLU, Gandhinagar who’s widely acknowledged as a dynamic and forward thinking visionary, whose expertise has immensely enriched the institutions he has touched. Prof. (Dr.) S. Shanthakumar is a renowned academician of stellar repute. He specializes in Environmental Law, International Law and Constitutional Law having also authored a host of books under his initials. He also the Chairs the Environmental Law Study Group of International Association of Law Schools.

The CAN Foundation has also recently announced the Second Edition of its flagship scholarship programme – Project Eklavya, applications for which are out now.
