Calcutta High Court directs Transgender Person to file fresh passport application, Mandates Identity Card be duly considered

Calcutta High Court: A petition was filed by the petitioner seeking relief in connection with the issuance of a passport to a transgender individual. Amrita Sinha, J., held that the transgender identity card of the petitioner shall be considered at the time of consideration of the petitioner’s application for passport.

The petitioner, identifying as transgender, had previously initiated an application for a passport. However, from the report filed by the Assistant Passport Officer of the Regional Passport Office, Kolkata, dated 17-06-2025, it emerged that the said application had lapsed over a year ago. As per the passport issuance rules and regulations, applications that are not acted upon or are incomplete within a stipulated timeframe lapse, requiring the applicant to initiate a fresh application.

Thus, the Court directed the petitioner to undertake the necessary procedural steps afresh in accordance with law, including submission of the requisite application, supporting documents, and payment of the prescribed fees.
