Karnataka High Court: R. Devdas, J., while dismissing this petition filed under Article 226 and 227 of the Constitution of India observed that the main matter itself was disposed of.
The petitioner, Arun had filed this petition to pray for the quashing of the final selection list of the post of Junior Engineer (Elect.) in which he was not considered. Instead, Respondent 2 was selected by Respondent 1 – KPTCL.
Respondent 1 in its statement of objections had stated that as per the applicable roster prescribed by the State Government, the post of Junior Engineer (Elect.) was reserved for persons with disability (PWD) which have a locomotor disability of one leg or hearing impairment.
Respondent 2 was found after physical examination with locomotor disability of one leg whereas the petitioner has no such disability in his legs.
In view of the above, the Court did not grant the prayer in the petition. The petition stood dismissed as it has no merit. [Arun v. Director (Admin. & HR), KPTCL, WP No. 102170 of 2018 (S-RES), decided on 11-10-2019]
