Naroda Patiya case : Judges to visit scene of the incident to get better idea of the case

Gujarat High Court: In a recent case, a Division Bench of the Court comprising Harsha Devani and A.S. Supehia, J.J. agreed to visit the scene of the incident to better understand the facts of the case.

Both the petitioner and the respondents had urged the Court to visit the place of incident to better comprehend how the incident had occurred and to understand the topography of the place which is spread over a considerable area.

With regard to the evidence on record, the Court found the request made by the advocates was reasonable and therefore agreed to the idea. The Court also stated that the date and time shall be communicated to the Additional Public Prosecutor for the purpose of making necessary arrangements and that he should maintain confidentiality of the observation with a view to escape unnecessary media attention. The Court also went on to observe that any intervention by the media during the course of such visit would amount to interference with judicial proceedings. [Mayaben Surendrabhai Kodnani v.
