Delhi High Court

On 13-1-2023, the High Court of Delhi notified the Live Streaming and Recording of Court Proceedings Rules of the High Court of Delhi, 2022. The rules came into effect on 13-1-2023.

Key Points:

  1. 5 cameras will be ordinally installed inside the Court Room.

  2. The Judge will be having a remote-control device to pause or stop the live streaming at any point.

  3. Apart from the following, all proceedings will be live streamed by the Court:

    • Matrimonial, child adoption and child custody cases

    • Sexual offences cases

    • Gender based violence against women cases

    • POCSO and Juvenile cases

    • Matters related to termination of pregnancy

    • Matters that the bench considers will be antithetical to publish

    • Matters that the bench considers can be provoke enmity amongst community

  4. Parties can object to the live streaming at the time of institution of the case or any time later.

  5. In the cases where the proceedings are not live streamed, the recording will be maintained for the usage of the Court and the Appellate Court.

  6. While the live streaming, the personal details of the parties will be masked either by muting or deleting that portion of the clip.

  7. The recording will be posted on the respective Court's website within 3 days of the conclusion of the proceedings.

  8. Disclaimers, Prohibitions and Restrictions:

    • Only authorized persons/ entity can record/ share/ disseminate live streamed proceedings or archival data.

    • Any person who is not authorized and share the data through print/ electronic media/ social media/ messaging applications will be prosecuted under Copyright Act, 1957, Information Technology Act, 2020 etc. and for Contempt of Court.

  9. Transcripts will be prepared only when it will be directed by the Court.

  10. The recordings will be made accessible for differently abled people.
