Karnataka High Court: <\/strong>While hearing the appeal of a mother who is seeking the custody of her\u00a0minor children under the prevailing provisions of the Guardians and Wards Act 1890, the Bench of\u00a0Sreenivas Hasrish Kumar J., agreed on the point made earlier by the Family Court, Belgaum that the respective\u00a0court did not have jurisdiction to entertain the present case and that\u00a0ordinary residence as mentioned in Section 9 of the Guardianship and Adoption Act does not include the temporary residence of children.<\/p>\n

In this case the Family Court at Belgaum had rejected the plea of the appellant because her children were not ordinarily residents of that place. They used to live with their father at Doha Qatar. \u00a0Following\u00a0this rejected petition, the appellant \u00a0appealed to the High Court where the Court considered\u00a0the fact of the \u00a0children’s residence and found no\u00a0infirmity or illegality in the\u00a0said order.\u00a0\u00a0The Court observed, “On reading of the Section,\u00a0it can be noticed that the application must be presented\u00a0before the Court having jurisdiction in the place where the\u00a0minor ordinarily resides. The word \u2018ordinarily\u2019 has got such a\u00a0meaning that it rules out temporary residence of the\u00a0children.”<\/p>\n
