{"id":91791,"date":"2016-12-12T14:13:15","date_gmt":"2016-12-12T08:43:15","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=91791"},"modified":"2016-12-12T14:13:15","modified_gmt":"2016-12-12T08:43:15","slug":"the-minerals-other-than-atomic-and-hydro-carbons-energy-minerals-concession-rules-2016-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/12\/12\/the-minerals-other-than-atomic-and-hydro-carbons-energy-minerals-concession-rules-2016-notified\/","title":{"rendered":"The Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016, notified"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>G.S.R. 1120(E).\u2014<\/strong> In exercise of the powers conferred by Section 13 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules to amend the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016, namely:\u2014<\/p>\n<p style=\"text-align: justify;\">\u00a01. (1) These rules may be called the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession (Amendment) Rules, 2016.<\/p>\n<p style=\"text-align: justify;\">(2) They shall come into force on the date of their publication in the Official Gazette.<\/p>\n<p style=\"text-align: justify;\">2. In the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016, in Rule 12, after sub-rule (5), the following sub-rule shall be inserted, namely:\u2013<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u00a0\u201c(5A) Notwithstanding anything contained in sub-rule (5), the State Government may grant a mining lease for area less than five hectares in respect of a mining lease to be granted in pursuance of the provisions of clause (b) or clause (c) of sub-section (2) of Section 10A of the Act:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">Provided that no mining lease shall be granted for area less than one hectare, in respect of small deposits (not fragmented portions of larger ones), shallow in nature, isolated and not exceeding two hundred metres in strike length, which are small by virtue of either origin or mode of emplacement or dislocation due to geological disturbances; and small deposits shall also include float deposits (transported) formed due to mechanical weathering and deposition, alluvial or eluvial placers (buried or otherwise), which generally have peculiar configurations excepting beach sands or placers:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">Provided further that no mining lease shall be granted for area less than two hectares, in respect of beach sands or placers, which are mono or multi mineral concentrations, including the dunes occurring on and off the coastal shore line deposited as a product of the ebb and flow of tides, waves and inshore currents, and at places semi-consolidated to consolidated in nature:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">Provided also that no mining lease shall be granted for area less than four hectares in all other cases other than those specified in the first and second provisos.\u201d.<\/p>\n<p style=\"text-align: right;\">[F.
