Karnataka High Court:<\/strong> While relying upon the decision of the Full Bench of Supreme Court\u00a0in Union of India<\/em> v. Oswal Woollen Mills Ltd.<\/em>, (1984) 2 SCC 646<\/a>, the Division Bench of H.G.\u00a0Ramesh, K.N. Phaneendra, JJ. held that if no time limit is fixed for compliance of an order, an\u00a0action for contempt of court is not maintainable.\u00a0The complainant had filed a petition to initiate contempt of court proceedings against the\u00a0accused for disobeying Karnataka High Court\u2019s order in N Rajanna v. State of Karnataka,\u00a0Writ Petition No. 22179 of 2014, wherein, the respondent was directed to consider the\u00a0request of the petitioner for regularization of his services. However, no time was fixed for\u00a0compliance of the order.<\/p>\n

The Court referred to the Supreme Court\u2019s observations in Oswal Woollen Mills Ltd<\/em>. wherein it\u00a0was held that where time is not fixed for taking action, failure to take action in the matter is\u00a0not contempt, and thereby held that the petition is not maintainable in law and accordingly\u00a0dismissed it.
