{"id":91311,"date":"2016-12-12T09:57:58","date_gmt":"2016-12-12T04:27:58","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=91311"},"modified":"2016-12-12T09:57:58","modified_gmt":"2016-12-12T04:27:58","slug":"fir-to-be-quashed-under-section-482-crpc-if-allegations-are-absurd","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/12\/12\/fir-to-be-quashed-under-section-482-crpc-if-allegations-are-absurd\/","title":{"rendered":"FIR to be quashed under Section 482 CrPC, if allegations are absurd"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Madhya Pradesh High Court:<\/strong> While relying upon the decision of Supreme Court in Ramesh Rajagopal v.\u00a0Devi Polymers (P) Ltd., <a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/2016_6_SCC_310\">(2016) 6 SCC 310<\/a>, the Single Bench of S.K. Awasthi, J. found that the allegations\u00a0made in FIR against applicants were absurd and thereby allowed their application seeking quashing of\u00a0FIR under Section 482 of the Code of Criminal Procedure, 1973.<\/p>\n<p style=\"text-align: justify;\">According to the complainant-wife, her in-laws had been harassing her for demand of an Indica Car, and\u00a0later evicted her out of the house. Since, she did not have any means to maintain herself, she made an\u00a0application for maintenance. Thereafter, the applicants were alleged to have visited her parents\u2019 house\u00a0and threatened her to withdraw the application. Upon a complaint case by her the police recorded the\u00a0FIR for commission of offences punishable under Sections 323, 294, 506 and 498-A read with Section 34\u00a0of IPC. After completion of investigation, the police filed charge-sheet against the applicants before the\u00a0Magistrate for the offences mentioned in the FIR. In order to seek quashing of FIR and subsequent\u00a0criminal proceedings, the instant application was filed.<\/p>\n<p style=\"text-align: justify;\">The Court observed that the allegations relating to commission of offence punishable under Section\u00a0498-A of IPC did not refer to any specific act of the applicants. The applicants had also brought on record\u00a0documents with respect to an Indica Car and other four-wheeler vehicles that were owned by them. On\u00a0consideration of these documents, the Court noted that the accusations regarding cruelty and\u00a0harassment for demand of Indica Car were absurd and improbable. Furthermore, the offence under\u00a0Section 294 of the IPC was not made out as the incident has taken place within the house of the\u00a0complainant-wife. Therefore, the FIR and the consequent proceedings so far as they related to the\u00a0offences punishable under Sections 498-A and 294 of IPC, were quashed.
