{"id":90711,"date":"2016-12-07T10:08:32","date_gmt":"2016-12-07T04:38:32","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=90711"},"modified":"2016-12-28T11:25:12","modified_gmt":"2016-12-28T05:55:12","slug":"a-son-irrespective-of-his-marital-status-will-have-no-legal-right-to-live-in-his-parents-self-acquired-house","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/12\/07\/a-son-irrespective-of-his-marital-status-will-have-no-legal-right-to-live-in-his-parents-self-acquired-house\/","title":{"rendered":"A son, irrespective of his marital status, will have no legal right to live in his parent\u2019s self-acquired house"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Delhi High Court:<\/strong> While deciding upon an issue related to possession of property between the\u00a0parties, the Bench of Pratibha Rani, J., held that \u201cin a self-acquired house of the parents, son\u00a0whether married or unmarried, has no legal right to live in that house and he can live in that\u00a0house only at the mercy of his parents up to the time the parents allow. Merely because the\u00a0parents have allowed him to live in the house so long as his relations with the parents were\u00a0cordial, does not mean that the parents have to bear his burden throughout his life.\u201d<\/p>\n<p style=\"text-align: justify;\">As per the facts of the present case, in February, 2014 the parents (respondents) of the appellants\u00a0filed a civil suit against their two sons and their wives seeking decree of permanent and mandatory injunction directing them to vacate the floors in their possession and also to restrain\u00a0them from creating any third party interest in the said property. The respondents contended that\u00a0they allowed their two sons and their wives to stay in their self-acquired house purely out of\u00a0affection and love; however the sons and their wives made the parents\u2019 life hell, so much so that\u00a0the parents had to resort to making police complaints against them. To sort out the matter\u00a0amicably a mediation process between the appellant and the respondents to sort out the issues\u00a0was initiated which failed to resolve the issue.\u00a0Perusing the documents and contentions of the parties the Court observed that the appellants\u00a0could not produce any evidence indicating that their parents have waived their ownership over\u00a0the property in question. The Court further observed that the respondents have duly established\u00a0their contention that they would have better rights\/entitlement to seek possession of the suit\u00a0property from their sons who were permitted to live in the house solely out of their love and\u00a0affection towards them. The Court also berated the appellant for abusing the process of courts by\u00a0seeking adjournment of the case on flimsy grounds (the present case was filed to request for an\u00a0adjournment on the ground that he wants to change his counsel, as his present counsel was\u00a0suffering from fever).
