{"id":87301,"date":"2016-11-23T12:23:37","date_gmt":"2016-11-23T06:53:37","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=87301"},"modified":"2018-04-27T11:30:05","modified_gmt":"2018-04-27T06:00:05","slug":"the-aircraft-amendment-rules-2016-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/11\/23\/the-aircraft-amendment-rules-2016-notified\/","title":{"rendered":"The Aircraft (Amendment) Rules, 2016, notified"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>G.S.R. 1077(E).\u2014<\/strong>The following draft of certain rules further to amend the Aircraft Rules, 1937, which the Central Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934), is hereby published as required by section 14 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration after a period of thirty days from the date on which copies of the Gazette of India, in which this notification is published, are made available to the public;<\/p>\n<p style=\"text-align: justify;\">Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite Safdarjung Airport, New Delhi-110003 or sent to dgoffice.dgca@nic.in.<\/p>\n<p style=\"text-align: justify;\">\u00a0Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period specified above will be considered by the Central Government.<\/p>\n<p style=\"text-align: center;\"><strong>Draft Rules<\/strong><\/p>\n<p style=\"text-align: justify;\">1. (1) These Rules may be called the Aircraft (\u2026\u2026. Amendment) Rules, 2016.<\/p>\n<p style=\"text-align: justify;\">\u00a0(2) They shall come into force on the date of their final publication in the Official Gazette.<\/p>\n<p style=\"text-align: justify;\">2. In the Aircraft Rules, 1937, &#8211;<\/p>\n<p style=\"text-align: justify;\">\u00a0(1) in Rule 133B for sub-rule (3), the following text shall be substituted, namely:-<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u201c(3) Where considered necessary, an organisation or a person engaged in one or more of the activities listed under clause (a) of sub-rule (1) shall operate under a system of approval as specified by the Director-General. The request for such approval shall be made to the Director-General in such form and manner as may be specified and on receipt of request, the Director-General may grant the approval on being satisfied that the applicant has complied with specific requirements. The approval shall be subject to such terms and conditions as may be specified.\u201d<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u00a0(b) after sub-rule (3A), the following sub-rule shall be inserted, namely:-<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u201c(3B) An approved organization or a person may approach to the Director-General at any time for extension of the scope of his work and the Director-General, on being satisfied that the specified requirements have been complied with, may grant approval for extension of scope as requested, or to a specific level, as deemed fit. The approval of the extension of scope, if any, granted under this sub-rule, shall be valid only up to the date of validity of the original approval.\u201d<\/p>\n<p style=\"text-align: justify;\">\u00a0(2) in Rule 133C,-<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(a) in sub-rule (1),<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(i) in clause (i), for the word and figures, \u201cRs. 25,000\/-\u201d, the word and figures, \u201cRs. 2,00,000\/-\u201d shall be substituted;<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(ii) in clause (ii), for the word and figures, \u201cRs. 50,000\/-\u201d, the word and figures, \u201cRs. 4,00,000\/-\u201d shall be substituted;<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(iii) in clause (iii), for the word and figures, \u201cRs.1,00,000\/-\u201d, the word and figures, \u201cRs. 8,00,000\/-\u201d shall be substituted;<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(b) in sub-rule (2), for the word, \u201crenewal\u201d, the words, \u201crenewal or extension of scope\u201d shall be substituted;<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(c) in sub-rule (2A), for the words, \u201cone lakh\u201d, the words, \u201ctwo lakhs\u201d shall be substituted.<\/p>\n<p style=\"text-align: right;\">\u00a0[F.
