G.S.R.1065(E).\u2014<\/strong>In exercise of the powers conferred by Section 5 read with sub-section (1) of Section 7 of \u00a0Employees\u2019 Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952), the Central Government hereby\u00a0makes the following Scheme further to amend the Employees\u2019 Provident Funds Scheme, 1952, namely:-
\n1. (1) This Scheme may be called the Employees\u2019 Provident Funds (Sixth Amendment) Scheme, 2016.
\n(2) It shall come into effect from the date of its publication in the Official Gazette.
\n2. In the Employees\u2019 Provident Funds Scheme, 1952, in paragraph 72, in sub-paragraph (6),-
\n(a) for the words \u201cceased to be employed\u201d, the words \u201cretired from service after attaining age of fifty-five\u00a0years or migrated abroad permanently\u201d shall be substituted;
\n(b) the words \u201cor transfer, as the case may be\u201d shall be omitted;
\n(c) after the proviso, the following new proviso shall be inserted, namely:-
\n\u201cProvided further that if any amount becoming due to a member, as a result of supplementary\u00a0contributions on account of litigation or default by the establishment or a claim which has been settled\u00a0but is received back undelivered not attributable to the member, shall not be transferred to the\u00a0inoperative account.\u201d.<\/p>\n

Note:<\/strong> The Employees\u2019 Provident Funds Scheme, 1952 was published in the Gazette of India, Part II, Section 3, sub-section (i) vide notification number S.R.O. 1509 dated the 2nd September, 1952 and was lastly amended\u00a0vide notification number G.S.R. 1035 (E) dated 2nd November, 2016.<\/p>\n
